1. Acceptance of Terms
By accessing or using the Wasel Canada website or mobile application (collectively, the "Platform"), you agree to be bound by these Terms & Conditions ("Terms"). These Terms form a legally binding agreement between you and Wasel Canada. If you do not agree to these Terms, please do not access or use the Platform. Your continued use of the Platform after any updates to these Terms constitutes your acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years of age to use the Wasel Canada Platform. By using the Platform, you represent and warrant that you are 18 years of age or older, that you have the legal capacity to enter into a binding agreement, and that your use of the Platform complies with all applicable laws and regulations. Wasel Canada reserves the right to refuse access to the Platform to any person at any time.
3. User Accounts and Account Security
To access certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information when registering and to keep your account information up to date. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify Wasel Canada immediately at [email protected] if you become aware of any unauthorized access to or use of your account. Wasel Canada is not liable for any loss or damage arising from your failure to protect your account credentials. You may not create more than one account, transfer your account to another person, or use another user's account without permission.
4. Listings and User-Generated Content
Users may post listings, advertisements, job postings, service offerings, business profiles, photos, descriptions, and other content on the Platform ("User Content"). You are solely responsible for the accuracy, completeness, legality, and appropriateness of any User Content you post. By posting User Content, you represent and warrant that you have the right to post it and that it does not violate any applicable law or the rights of any third party. You grant Wasel Canada a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute your User Content in connection with operating and promoting the Platform. Wasel Canada does not endorse, verify, or guarantee the accuracy of any User Content and is not responsible for User Content posted by users.
5. Prohibited Items and Activities
You agree not to use the Platform to post, list, advertise, or facilitate the sale or exchange of: illegal items or substances; weapons, firearms, or ammunition except where expressly permitted by applicable law; counterfeit, stolen, or fraudulently obtained goods; items that infringe intellectual property rights; adult content or services; or any item or service whose sale or promotion is prohibited under applicable Canadian law. You also agree not to: post false, misleading, or deceptive content; harass, threaten, or abuse other users; collect personal information about other users without their consent; transmit spam, malware, or malicious code; attempt to circumvent any security or access controls on the Platform; use automated tools to scrape or extract data from the Platform without authorization; impersonate any person or entity; or engage in any activity that violates applicable laws or regulations.
6. Fraud and Misleading Listings
Wasel Canada takes fraud and misleading listings seriously. You must not post listings that misrepresent the nature, condition, price, availability, or ownership of any item, job, service, or business. You must not engage in price manipulation, bait-and-switch tactics, or any other deceptive practice. You must not create fake accounts, post duplicate listings, or artificially inflate the visibility of your listings. Wasel Canada reserves the right to remove listings, suspend accounts, and report suspected fraud to law enforcement authorities. If you suspect a listing or user is fraudulent, please report it to us at [email protected].
7. Jobs and Employment Listings
Users may post and search for job opportunities on the Platform. Job listings must accurately describe the position, requirements, and any compensation offered. You must not post fake, misleading, or discriminatory job listings. Wasel Canada does not act as an employer, recruiter, or employment agency and is not a party to any employment arrangement between users. Wasel Canada does not verify the credentials of employers or job seekers and does not guarantee the accuracy of any job listing. Users are responsible for conducting their own due diligence before entering into any employment arrangement. Job listings must comply with all applicable Canadian employment and human rights laws.
8. Services and Business Listings
Users may advertise services and create business listings on the Platform. Service and business listings must accurately represent the services offered, qualifications, pricing, and availability. Wasel Canada does not verify the credentials, licences, qualifications, or insurance of any service provider or business listed on the Platform. Wasel Canada is not a party to any service agreement between users and is not responsible for the quality, safety, or outcome of any service arranged through the Platform. Users engaging service providers are responsible for verifying credentials and suitability before entering into any agreement.
9. Advertising and Sponsored Content
Wasel Canada may offer paid advertising, promoted listings, or sponsored placement options on the Platform. Sponsored or promoted content will be identified as such where required. Advertisers are responsible for ensuring that their advertising content complies with these Terms and all applicable laws, including Canadian advertising standards. Wasel Canada reserves the right to refuse, remove, or modify any advertising content that violates these Terms or that we determine is inappropriate.
10. Communications Between Users
The Platform provides messaging and communication features to allow users to connect with one another. You agree to use these features respectfully and in accordance with these Terms. You must not use Platform communications to harass, threaten, spam, or defraud other users. Wasel Canada does not read private messages between users except where necessary to investigate reports of abuse, fraud, or violations of these Terms. Wasel Canada is not responsible for the content of communications between users. If you receive communications that you believe violate these Terms, please report them to [email protected].
11. Transactions Between Users
Wasel Canada provides a platform that connects buyers, sellers, employers, job seekers, service providers, and businesses. Wasel Canada is not a party to any transaction, sale, purchase, employment arrangement, service agreement, payment, delivery, meeting, or other arrangement made between users. Wasel Canada does not process payments, arrange delivery, provide escrow services, guarantee the completion of any transaction, or verify the identity, credentials, or reliability of any user. Users are solely responsible for verifying listings, businesses, employers, buyers, sellers, and service providers, and for conducting all transactions safely and in accordance with applicable law. Wasel Canada strongly encourages users to meet in safe, public locations when conducting in-person transactions and to exercise caution at all times.
12. User Safety
Your safety is important to us. Wasel Canada does not perform background checks on users and cannot guarantee the identity or intentions of any user. When meeting another user in person, we recommend choosing a safe, public location; bringing a trusted person with you; informing someone you trust of your plans; and trusting your instincts. Never share sensitive personal or financial information with other users beyond what is necessary to complete a transaction. If you encounter a situation that you believe poses an immediate risk to your safety or the safety of others, contact local emergency services. 13. Intellectual Property
All content, trademarks, logos, trade names, software, and other intellectual property on the Wasel Canada Platform that is not User Content is owned by or licensed to Wasel Canada. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any Platform content without our express written permission. Nothing in these Terms grants you any ownership interest in the Platform or its intellectual property. If you believe that content on the Platform infringes your intellectual property rights, please contact us at [email protected] with details of your claim.
14. Privacy
Your use of the Platform is governed by our Privacy Policy, available at waselcanada.ca/privacy-policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy. Please review our Privacy Policy carefully to understand our practices.
15. Account Suspension and Termination
Wasel Canada reserves the right to suspend, restrict, or permanently terminate your account and access to the Platform at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or illegal activity, or acted in a manner that is harmful to other users or to Wasel Canada. You may close your account at any time by contacting us at [email protected]. Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination will continue to apply, including intellectual property rights, disclaimers, and limitations of liability.
16. Disclaimers
The Wasel Canada Platform is provided on an "as is" and "as available" basis. Wasel Canada makes no representations or warranties of any kind, express or implied, regarding the Platform or its content, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. Wasel Canada does not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Wasel Canada does not endorse, verify, or guarantee any listing, user, employer, service provider, or business on the Platform. Your use of the Platform and any transactions or arrangements you enter into with other users are entirely at your own risk.
17. Limitation of Liability
To the fullest extent permitted by applicable law, Wasel Canada and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of or inability to use the Platform, interactions or transactions between users, User Content, or unauthorized access to your account or data. Wasel Canada does not exclude or limit any liability that cannot lawfully be excluded or limited under applicable Canadian or Ontario law. To the extent liability may lawfully be limited, Wasel Canada's aggregate liability arising out of or relating to the Platform will be limited to the amount paid by you to Wasel Canada, if any, during the twelve (12) months immediately preceding the event giving rise to the claim.
18. Changes to These Terms
Wasel Canada may update these Terms from time to time to reflect changes in our practices, the Platform, or applicable law. When we make material changes, we will update the Last Updated date at the top of this page and, where appropriate, notify you through the Platform or by email. Your continued use of the Platform after updated Terms are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform.
19. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, Canada. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
